Terms of Service — Attendance App

These Terms of Service (“Terms”) govern your access to and use of the Calenzos attendance application (“App”), developed and operated by Sismatix Information Technology (“we”, “our”, or “us”). By accessing or using the App, you agree to be bound by these Terms.

1.

Use of the Application

The Calenzos app is intended for businesses using the MatixERP platform to manage employee attendance based on geolocation. You agree to use the App only for lawful purposes and in accordance with these Terms.

2.

Eligibility

To use this App, you must be authorized by a subscribing business client of MatixERP. Individual end users must have proper credentials provided by their employer.

3.

Privacy and Data Use

By using the App, you consent to the collection and use of location data strictly for attendance validation.

4.

Location-Based Features

The App relies on your device’s GPS or location services. By enabling attendance, you grant permission for the App to access your location. We do not track or store location data beyond what’s necessary to verify check-in and check-out actions.

5.

Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

6.

Restrictions

You may not:

  • Reverse-engineer or copy the App;

  • Use the App to interfere with other users or networks;

  • Attempt unauthorized access to systems or data.

7.

Service Availability

We aim to ensure high availability, but the App may experience occasional interruptions due to maintenance or third-party service dependencies (e.g., Google Maps).

8.

Limitation of Liability

Sismatix shall not be held liable for any indirect, incidental, or consequential damages arising from the use or inability to use the App.

9.

Modifications to the Terms

We reserve the right to update these Terms at any time. Continued use of the App after such updates constitutes your agreement to the revised Terms.

10.

Governing Law

These Terms shall be governed by the laws of the State of Kuwait. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of Kuwaiti courts.
